DECISION No. 1
of the MINISTER OF FOREIGN AFFAIRS
of 4 January 2010
concerning the scope of responsibilities of secretaries of state and under-secretaries of state
at the Ministry of Foreign Affairs and scope of substitution of the Minister of Foreign Affairs by secretaries of state
Pursuant to Article 37 Section 2 and Section 5 of the Act of 8 August 1996 on the Council of Ministers (Dziennik Ustaw of 2003 No. 24 Item 199, No. 80 Item 717 from 2004 No. 238 Item 2390 and No. 237 Item 2703, from 2005 No. 169 Item 1414 and No. 249 Item 2104, from 2006 No. 45 Item 319, No. 170 Item 1217, No. 220 Item 1600, from 2008 No. 227 Item 1505 and from 2009 No. 42 Item 337, No. 98 Item 817, No. 157 Item 1241 and No. 161 Item 1277), it is resolved as follows:
§1.
The following scopes of responsibilities of secretaries of state and under-secretaries of state at the Ministry of Foreign Affairs are hereby established:
1) Jan Borkowski, Secretary of State, shall
a) Be in charge of cooperation with the Sejm (lower chamber of the parliament) and Senate, assuming the function of the Parliamentary Secretary, save for the matters relative to the Republic of Poland’s membership of the European Union;
b) Be in charge of coordination and programming of Poland’s promotion in the world, and its foreign cultural, scientific and educational policy, and shall oversee Public and Cultural Diplomacy Department;
c) Deal with the issues relative to Polish Diaspora and shall oversee Department of Cooperation with Polish Diaspora;
d) Be in charge of information and educational activity aiming to disseminate knowledge about European integration and operation of the European Union and the related policy of the Council of Ministers and shall oversee European Information Department;
e) Deal with the matters relative to social dialogue;
f) Be involved in the work of Interdepartmental Task Force for Polish Diaspora and Poles Abroad;
g) Be involved in the work of Joint Committee of Central and Local Government;
h) Receive complaints and motions from inquirers; and
i) In the absence of Jan Borkowski, Secretary of State, first Andrzej Kremer, Under-Secretary of State, then Paweł Wojciechowski, Under-Secretary of State, Grażyna Bernatowicz, Under-Secretary of State, Jacek Najder, Under-Secretary of State, Piotr Serafin, Under-Secretary of State, Maciej Szpunar Under-Secretary of State, and Mikołaj Dowgielewicz, Secretary of State shall deputise for him.
2) Mikołaj Dowgielewicz, Secretary of State, shall
a) Assume the function of the Secretary for European Affairs;
b) Participate in the meetings of the Standing Committee of the Council of Ministers;
c) Be in charge of implementation of the tasks relative to involvement of the Polish government administration bodies in the work of the institutions of the European Union;
d) Be in charge of implementation of the tasks relative to preparation of the Polish government administration bodies to perform tasks stemming from the Republic of Poland’s membership of the European Union and shall oversee Department of the Committee for European Affairs and Department of Coordination of Poland’s Presidency of EU Council;
d) Be in charge of cooperation with the Sejm and Senate in the matters relative to the Republic of Poland’s membership of the European Union;
e) Deal with the issues relative to employment of Polish nationals in the institutions and agencies of the European Union;
f) Be involved in the work of Interdepartmental Task Force for Assurance of Security in the Course of Preparation for and Exercise of Presidency of the EU Council by the Republic of Poland in the year 2011;
h) Oversee efforts aiming to educate public administration employees in the area of European affairs; and
i) In the absence of Mikołaj Dowgielewicz, Secretary of State, first Piotr Serafin, Under-Secretary of State, and then Grażyna Bernatowicz, Under-Secretary of State, Maciej Szpunar, Under-Secretary of State, Andrzej Kremer, Under-Secretary of State, Paweł Wojciechowski, Under-Secretary of State, Jacek Najder, Under-Secretary of State, and Jan Borkowski, Secretary of State, shall deputise for him.
3) Grażyna Bernatowicz, Under-Secretary of State, shall
a) Be responsible for the political dimension of European cooperation and shall oversee European Policy Department;
b) Deal with human rights’ issues, save for the matters for which Bureau of the Plenipotentiary for Proceedings before International Human Rights Protection Bodies is competent;
c) Deal with the issues relative to the United Nations, excluding the issues relative to economics and finance, Council of Europe, Community of Democracies and the OSCE Office for Democratic Institutions and Human Rights, and shall oversee Department of United Nations and Human Rights;
d) Coordinate the issues relative to the European affairs and Latin America and to the Caribbean in the work of the Ministry and shall oversee Department of Central and Southern Europe and Department of Western and Northern Europe;
e) Deal with the issues of foreign cooperation of provincial local governments as defined under separate regulations; and
f) In the absence of Grażyna Bernatowicz, Under-Secretary of State, first Jacek Najder, Under-Secretary of State, and then Andrzej Kremer, Under-Secretary of State, Piotr Serafin, Under-Secretary of State, Paweł Wojciechowski, Under-Secretary of State, Maciej Szpunar, Under-Secretary of State, Jan Borkowski, Secretary of State, and Mikołaj Dowgielewicz, Secretary of State, shall deputise for her.
4) Andrzej Kremer, Under-Secretary of State, shall
a) Deal with legal and treaty issues and shall oversee Department of Legal and Treaty Issues and Bureau of the Plenipotentiary for Proceedings before International Human Rights Protection Bodies;
b) Deal with consular issues and shall oversee Department of Consular Affairs;
c) Coordinate the work on the Eastern foreign policy at the Ministry and shall oversee Eastern Department;
d) Sign regulatory acts and other legal acts as well as notices, statements and communiqués sent for publication to Dziennik Ustaw Rzeczypospolitej Polskiej or Dziennik Urzędowy Rzeczypospolitej Polskiej „Monitor Polski";
e) Be involved in the work of the Concordat Commission;
j) Be involved in the work of Interdepartmental Task Force for Humanitarian Law;
g) Be involved in the work of Interdepartmental Task Force for International Sanctions;
h) Be involved in the work of Council of Ministers’ Committee for Computerisation and Communication; and
i) In the absence of Andrzej Kremer, Under-Secretary of State, first Grażyna Bernatowicz, Under-Secretary of State, and then Jacek Najder, Under-Secretary of State, Paweł Wojciechowski, Under-Secretary of State, Maciej Szpunar, Under-Secretary of State, Piotr Serafin, Under-Secretary of State, Jan Borkowski, Secretary of State, and Mikołaj Dowgielewicz, Secretary of State, shall deputise for him.
5) Jacek Najder, Under-Secretary of State, shall
a) Be in charge of outlining and implementing the security policy, including defence, disarmament, non-proliferation and arms exports control in the global, multilateral and bilateral dimensions and shall oversee Department of Security Policy and Operations Centre;
b) Deal with the issues relative to Common Foreign and Security Policy and shall oversee Department of Common Foreign and Security Policy;
c) Coordinate the work on North American, Middle East and African foreign policy at the Ministry and shall oversee Department of the Americas and Department of Africa and the Middle East;
d) Coordinate cooperation of the Ministry of Foreign Affairs with secret services;
e) Be involved in the work of the Steering Committee on development of a management plan for the former Auschwitz-Birkenau extermination camp;
f) Be involved in the work of Government Task Force for Crisis Management;
g) Oversee Diplomatic Protocol, subject to the provisions of §2; and
h) In the absence of Jacek Najder, Under-Secretary of State, first Grażyna Bernatowicz, Under-Secretary of State, and then Andrzej Kremer, Under-Secretary of State, Paweł Wojciechowski, Under-Secretary of State, Piotr Serafin, Under-Secretary of State, Maciej Szpunar, Under-Secretary of State, Jan Borkowski, Secretary of State, and Mikołaj Dowgielewicz, Secretary of State, shall deputise for him.
6) Piotr Serafin, Under-Secretary of State, shall
a) Be in charge of developing the economic dimension of European and global foreign policy and shall oversee Department of Foreign Economic Policy;
b) Deal with the issues relative to Organisation for Economic Co-operation and Development (OECD), World Trade Organisation (WTO), the economic dimension of United Nations system and G-20;
c) Be involved in the work of Interdepartmental Task Force for OECD Affairs;
d) Be involved in the work of Interdepartmental Task Force for Implementation of Lisbon Strategy in Poland;
e) Be involved in the work of Task Force for WTO Affairs;
f) Be involved in the work of Interdepartmental Task Force for Maritime Policy of the Republic of Poland;
g) Be involved in the work of Task Force/Committee for Monitoring Rural Areas Development Plan;
h) Be involved in the work of the Committee Monitoring Rural Areas Development Program for Years 2007-2013;
i) Be involved in the work of the Committee Monitoring Sectoral Operational Programme Restructuring and Modernisation of Food Sector and Rural Areas Development;
j) Be involved in the work of the Coordinating Committee for Development Policy;
k) Be involved in the work of Steering Committee (to decide on organisation of Poland’s efforts arising from the European Commission’s White Paper, Adapting to climate change: Towards a European framework for action COM(2009)147;
l) Oversee Department of Strategy and Foreign Policy Planning, subject to the provisions of § 2 Section 1; and
m) In the absence of Piotr Serafin, Under-Secretary of State, first Paweł Wojciechowski, Under-Secretary of State, and then Maciej Szpunar, Under-Secretary of State, Grażyna Bernatowicz, Under-Secretary of State, Andrzej Kremer, Under-Secretary of State, Jacek Najder, Under-Secretary of State, Mikołaj Dowgielewicz, Secretary of State, and Jan Borkowski, Secretary of State, shall deputise for him.
7) Maciej Szpunar, Under-Secretary of State, shall
a) Be in charge of the process of transposition of the law of the European Union to the Polish law system;
b) Be in charge of preparation of opinions on consistency with the law of the European Union of government draft acts of commonly applicable law and draft international agreements;
c) Be in charge of preparation of opinions, on the principles defined in the regulations of the Sejm, on consistency of draft acts with the law of the European Union;
d) Be in charge of cooperation of the Polish government administration bodies and shall initiate and monitor the work on approximation of the Polish law to the law of the European Union and oversee Department of European Union Law;
e) Coordinate efforts of the Polish government administration bodies aimed at protection of the interests of the Republic of Poland in the proceedings before judicial bodies of the European Union and the Court of the European Free Trade Association (EFTA Court);
f) Assure, subject to the separate regulations, representation of the Republic of Poland in the proceedings before judicial bodies of the European Union and the Court of the European Free Trade Association (EFTA Court);
g) Be involved in the work of Task Force (established to carry out a review of proposals submitted by individual ministers for the list of statutory acts to be amended in connection with the need for comprehensive implementation of Directive 2006/123/EC on services in the internal market); and
h) In the absence of Maciej Szpunar Under-Secretary of State, first Piotr Serafin, Under-Secretary of State, and then Grażyna Bernatowicz, Under-Secretary of State, Andrzej Kremer, Under-Secretary of State, Paweł Wojciechowski, Under-Secretary of State, Jacek Najder, Under-Secretary of State, Mikołaj Dowgielewicz, Secretary of State, and Jan Borkowski, Secretary of State, shall deputise for him.
8) Paweł Wojciechowski, Under-Secretary of State, shall
a) Be in charge of international development policy by assuming the function of Country Coordinator for International Development Cooperation and shall oversee Department of Development Cooperation and Department of Implementation of Development Programmes;
b) Be in charge of the efforts to support promotion of Polish economy and shall oversee Department of Economic Diplomacy;
c) Coordinate the work on the Asian foreign policy at the Ministry and shall oversee Department of Asia and Pacific Region;
d) Cooperate on outlining and implementing the National Cohesion Strategy;
e) Coordinate, oversee and monitor efforts associated with utilisation of funding originating from European Union PHARE programmes and Transition Facility;
f) Be involved in the work relative to Norwegian Financial Mechanism;
g) Be involved in the work of Export Insurance Policy Committee;
h) Be involved in the work of Interdepartmental Task Force for Restructuring of Defence Industry;
i) Be involved in the work of Interdepartmental Task Force for Foreign Investment;
j) Be involved in the work of the Programme Board of the 2011 national population and housing census;
k) Present the position of the Minister of Foreign Affairs when examining the draft budget act and shall participate in the work relative to defining the 45th portion of the state budget, Foreign Affairs and Republic of Poland’s Membership of the European Union, as well as internal finance policy,
l) Be involved in the work of the Offset Committee;
m) In the absence of Paweł Wojciechowski, Under-Secretary of State, first Piotr Serafin, Under-Secretary of State, and then Grażyna Bernatowicz, Under-Secretary of State, Jacek Najder, Under-Secretary of State, Andrzej Kremer, Under-Secretary of State, Maciej Szpunar, Under-Secretary of State, Jan Borkowski, Secretary of State, and Mikołaj Dowgielewicz, Secretary of State, shall deputise for him.
§2.
1. Matters relative to strategy and programming of Poland’s foreign policy and coordination of diplomatic protocol, issuance of authorisations and budgetary, asset and personnel issues for the management of which no personal authorisation have been issued shall fall within the exclusive competence of the Minister of Foreign Affairs.
2. Secretaries and under-secretaries of state shall cooperate with territorial departments based on the scope of their designated areas of responsibility. Territorial departments shall be subject to overall supervision by designated under-secretaries of state in terms of work organisation and evaluation. To perform the allocated tasks, including also coordination of territorial issues, secretaries and under-secretaries of state may convene coordination meetings with participation of competent members of the Management of the Ministry of Foreign Affairs.
§3.
1. In the absence of the Minister of Foreign Affairs, Jan Borkowski, Secretary of State, and in the absence of Jan Borkowski, Secretary of State, Mikołaj Dowgielewicz, Secretary of State, shall deputise for the Minister.
2. Secretaries of state shall be authorised to deputise for the Minister of Foreign Affairs during his absence in all matters, save for:
1) Matters relative to strategy and programming of Poland’s foreign policy;
2) Coordination of diplomatic protocol;
3) Signing of regulatory acts and other legal acts of the Minister of Foreign Affairs;
4) Filing of motions to award orders and decorations;
5) Matters relative to employment of Political Cabinet staff; and
6) Budgetary, asset and personnel issues, including issuance of authorisations.
§4.
Decision no. 23 of the Minister of Foreign Affairs of 15 April 2009 concerning the scope of responsibilities of a secretary of state and under-secretaries of state at the Ministry of Foreign Affairs and the scope of substitution of the Minister of Foreign Affairs by the secretary of state and Decision no. 33 of the Minister of Foreign Affairs of 30 May 2009 amending the decision concerning the scope of responsibilities of a secretary of state and under-secretaries of state at the Ministry of Foreign Affairs and the scope of substitution of the Minister of Foreign Affairs by the secretary of state shall expire.
§5.
This decision comes into force as of the date of its signing.
